These terms and conditions (the"Terms and Conditions") are the terms and conditions upon which Sick-Note ("we/us") make this website (the "Sick-Note Site") available to you and any of our services which are accessible on or via the Sick-Note Site (the "Sick-Note Service").

These Terms and Conditions govern your use of the Sick-Note Site and the Sick-Note Service.


Products

1.1 All products as depicted on this website (as may be varied from time to time) are available for delivery almost everywhere on mainland UK. Packs containing frozen meals cannot be delivered outside what we classify Central & Zone 2 London postcodes. Packs containing frozen meals cannot be deliver on any service other than same day and therefore cannot be delivered outside what we classify Central & Zone 2 London- in this case we will substitute this item with a product/s of equal value and quality.

1.2  All medicines within our packs are Over The Counter drugs but medicine instructions should always be read before product use.

1.3 As expectant mothers should avoid use of any essential oils in products while pregnant we advise those customers purchasing Sick & Tired to opt for the "expectant mother" option as opposed to the "new mother" option within this pack. We advise you to always read the ingredients before product use.

1.4 All products are subject to availability. In the event of any supply difficulties, we reserve the right to substitute with a product of equival value and quality without notice.

1.5 In the event that we are unable to supply all or part of your order (the product or any substitute product to you at all), we shall notify you as soon as possible and reimburse your payment in full no later than 30 days after the intended delivery/collection date.

1.6 Products are delivered in accordance with our delivery terms.

 

1.7.1 Within Central London: 

 

 

We classify the following postcodes as "Central London" for our same day delivery service: EC1A, EC1M, EC1N, EC1P, EC1V, EC1Y, EC2A, EC2M, EC2P, EC2R, EC2V, EC2Y, EC3A, EC3M, EC3N, EC3P, EC3R, EC3V, EC4A, EC4M, EC4N, EC4P, EC4R, EC4V, EC4Y, N1(Kings Cross), NW1 (Regent's Park, Euston, Euston Square), SE1, SW1, SW7, W1, W2, W8, W11, WC1, WC2.

1.7.2 Within London Zone 2: 

 

We classify the following postcodes as "London Zone 2" for our same day delivery service:

Under this service we

1.7.3 Mainland UK & Greater London: Standard Delivery

 

We deliver within 3-5 Days via Royal Mail. We reserve the right to deliver outside the aforementioned time frame in circumstances of extreme weather conditions. Under this delivery service we cannot deliver a homemade meal (this affects Sick As A Dog & Sick To My Stomach Hampers) but we will substitute this item with a product of equal value and quality. This does not affect your statutory rights.


1.7.4 Mainland UK & Greater London: Within 24 hours

We deliver by courier within 48 hours of order being placed when orders are placed before 11am. Under this delivery service we cannot deliver a homemade meal (this affects Sick As A Dog & Sick To My Stomach Hampers) but we will substitute this item with a product of equal value and quality. We reserve the right to deliver outside the aforementioned time frame. This does not affect your statutory rights.

1.7.5 Outside mainland UK: We currently do not deliver outside mainland UK. 

  

Prices

2.1 Prices listed within the Sick-Note Service are valid for a maximum of 14 days of submitting your order.

2.2 Except where stated product prices exclude Sick-Note Delivery.

2.3 A processing fee may be applied to orders when using the following credit cards: Visa, MasterCard, Cirrus, Maestro and PayPal.


Orders / Payment

3.1 You will be given clear instructions to navigate the order process and will be required to provide us with your complete personal details, including accurate postcode, together with those of the intended recipient and all necessary payment details.

3.2 We accept payment by Paypal Visa, MasterCard, Cirrus and Maestro. We do not accept Diners, American Express, department store cards and any other credit and/or debit cards as we may specify from time to time.

3.3 By clicking on the 'place my order' button at the end of the order process, you are consenting to be bound by our terms and conditions contained in these Terms and Conditions and appearing anywhere on the Sick-Note site.

3.4 Submitting your order is subject to our acceptance of this offer. We will send an email confirmation of your order details to advise that we are processing your order via the email address you provide. We will not consider ourselves bound by a contract with you until we have issued this email confirmation.

3.5 We cannot accept orders from customers under the age of eighteen (18) years.

3.6 We cannot accept orders for delivery outside mainland UK.


Delivery

4.1 Except where stated, Standard Delivery is to Mainland UK and Greater London addresses within  3 to 5 days using Royal Mail and is charged at £6.99. 

A charge of £10 will be applicable for same day courier deliveries  "Central London" postcodes as follows:

A charge of £10  will be applicable for same day courier deliveries within "London Zone 2" postcodes as follows:

A charge of £10 will be applicable for courier deliveries to Greater London & Mainland UK within 48 hours.
Please note that, for all delivery services, at certain times of the year these prices can vary. If you request delivery to remote areas which are not normally delivered to by Sick-Note you will be advised of any additional charges as soon as possible upon receipt of your order.

4.2 Selected products are not available for delivery to certain areas - where possible we will advise you of these restrictions before you place your order however as standard meals cannot be delivered outside Central & Zone 2 London in this instance we will substitute this item with a product/s of equal value and quality.  

4.3  Every effort will be made to deliver on your chosen date, however the exact delivery date cannot be guaranteed when you select our Standard, Royal Mail delivery option. Courier deliveries are not available at Weekends or on Bank Holidays, on orders placed after 11am on a Friday under our same day delivery service and will be delivered the following working day. Orders placed outside our office hours, Monday to Friday 9am - 6pm excluding Bank Holidays, will not be processed until the following working morning.

4.3.1 We do not recommend courier deliveries to hospitals.

4.4 Delivery Services - Should you require your delivery to be made within a specific time period we are able to offer this on a case by case basis. Please note some services are subject to availability and at certain times of the year these prices can vary, please contact us directly my email at orders@sick-note.com or by telephone, +44 (0) 207 428 9777, for your specialised quote for this service. 

4.5 Delivery is not available on Saturday, Sundays or public holidays, orders will be delivered on the next working day.

4.7 To avoid problems or delays with delivery, please ensure that you have included the full address details, including accurate postcode of the intended recipient along with their apartment/office number and telephone number, together with your daytime contact telephone number or e-mail address so that we can notify you in the event that any delivery problems are encountered.

4.8 Whilst we agree to use all reasonable endeavours to ensure that delivery will be on the requested delivery date or during the delivery period, you acknowledge that actual delivery may be via a third party courier service. In very occasional circumstances delivery on the requested terms will not be possible, in such circumstances you will be given prior notice wherever possible and we shall either make alternative arrangements or reimburse your payment in full in accordance with clause 1.5 above. Goods delivered via third party services are generally despatched 48 hours before the requested delivery date for most UK mainland addresses. 

4.10 In the case of delivery to certain locations, where a third party is involved, such as offices, hospitals, Funeral Directors, airports, hotels, ships and other business locations, the signature of any person authorised to accept delivery on behalf of the organisation shall be accepted as proof of delivery to your chosen recipient. Please be advised that some products are unsuitable for delivery to Funeral Directors, Hospitals, airports or ships please contact the Sick-Note Customer Contact Centre for further information using the contact details set out in Section 6 below.

4.11 Please be aware that the carrier will deliver the goods to the address provided in good faith and we cannot accept responsibility if the intended recipient is no longer at that address and the receiver refuses or fails to return the items(s).

4.12 Please note that where the carrier is unable to find someone to accept delivery, or unable to leave the delivery in a secure location, they will leave a card at the address for the recipient to make contact and re-arrange delivery. We reserve the right to charge for re-delivery to that or an alternative address.

4.13 we currently do not deliver orders outside the UK, including Channel Islands, the North & Republic of Ireland. 

4.14 Before placing your order, please review delivery cut-off times & prices.

4.15 We shall not be liable for any failure to perform in our obligations where such failure is as a result of Acts of God (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labour dispute, strike, lockout or interruption or failure of electricity or telephone service or any interruption to courier or Royal Mail delivery services.


Cancellation/Amendments

5.1 If, for any reason, you wish to change or cancel your order you can do so by calling 0207 428 97 77 or emailing orders@sick-note.com. Please give 36 hours notice before the requested delivery date.

5.2 We regret that you may not cancel an order for products once your order has been dispatched.

5.3 In the event that goods are to be returned please return to: Sick-Note, 87-88 Turnmill Street, London EC1M 5QU and once we can confirm that no product items have been opened, used or damaged you will receive a full refund.

6.2 Our Customer Service Contact Centre is available from 9am until 6pm Monday to Friday.

6.3 Because of the perishable nature of most products and in order to assist us in resolving any complaints quickly and to our mutual satisfaction, we advise you to make any complaint within 1 working day of the date of delivery or intended delivery of your purchase.

 

Disclaimer

7.1 Whilst we agree to use all reasonable endeavours to ensure that the Sick-Note Site and/or the Sick-Note Service is fully operational and error-free we cannot guarantee this and, therefore, accept no responsibility for any defects and/or interruption of the Sick-Note Site and/or the Sick-Note Service and shall be released from our obligations under these Terms and Conditions in the event of any cause beyond our reasonable control which renders the provision of the Sick-Note Site and/or the Sick-Note Service impossible or impractical.

7.2 (a) We accept liability for death or personal injury arising from our negligence.

7.2 (b) Subject to clause 7.2(a), our liability in contract, tort (including negligence and breach of statutory duty) or otherwise arising by reason of or in connection with your order with us shall be limited to a multiple of [5] times the price you have paid for the products.

7.2 (c) Subject to clauses 7.2(a) and 7.2(b) above we exclude all liability for any claims, losses, demands and damages, including without limitation, any costs, loss of profits, loss of contracts or business opportunity, loss of data and any other consequential, incidental, special or punitive damages, even if we have been advised of the possibility of such damages, arising directly or indirectly out of or in any way connected with your use or inability to access the Sick-Note Site and/or the Sick-Note Service, whether arising in contract, tort (including negligence), under statute or otherwise provided that nothing contained in these Terms and Conditions affects or will affect your or the recipient's statutory rights in relation to the quality, fitness or description of the products supplied.

7.2 (d) Subject to clauses 1.5 and 4.8 above, we shall not be liable for any delay or inability to perform our obligations to you if such delay is due to any cause whatsoever beyond our reasonable control.

 

Use of Sick-Note.com discount voucher codes

8.1 Sick-Note.com discount voucher codes (also abbreviated to 'Voucher codes') can only be used against purchases made on Sick-Note.com for delivery to Mainland UK addresses only.

8.2 Voucher codes must be entered in the relevant section of the order process on Sick-Note.com which it at check out. We are unable to apply a discount to orders already placed.

8.3 Voucher codes are restricted to one use per customer and should not be passed on to additional recipients.

8.4 Voucher codes may also be set to a maximum number of redemptions - if we are not able to accept the discount code you have entered it will be because the code has expired or maximum redemption level for promotion exceeded. We will advise you accordingly in the order process and the discount will not be applied.

8.5 Selected voucher codes may be restricted for use against specified products - where possible, details of any restrictions will be communicated at the point where we promote the voucher code to you.

8.6 Voucher codes cannot be exchanged for a cash alternative or used in conjunction with any other promotions.

8.7 Where the voucher code entitles you to a percentage discount, the discount will not be applied to the delivery charge ('delivery' includes additional delivery services, which are charged in conjunction with Sick-Note Delivery, for example 'same day' delivery charge).

8.8 Where the voucher code entitles you to a free delivery offer, this will be for Sick-Note UK standard next day delivery charge (£10). Certain delivery dates however incur additional charges, such as delivery on Sunday's or Bank Holiday's etc.

8.9 Voucher codes may be withdrawn, or suspended without notice for any reason. We will advise you within the order process if we cannot accept the discount code you have entered.

8.10 We cannot be held responsible for non-availability of Sick-Note.com which may prevent use of Voucher codes.

8.11 Changes to these terms of use may be made at any time.

 

General

9.1 We reserve the right to supplement and amend the Terms and Conditions on which you are permitted access to the Sick-Note Site and/or the Sick-Note Service from time to time. We will post any changes on the Sick-Note Site and it is your responsibility as a customer to review the Terms and Conditions on each occasion you access the Sick-Note Service or Sick-Note Site. Changes will be effective five (5) hours after the posting of any such change and all subsequent dealings between you and us shall be on the new terms and conditions.

9.2 Additionally, we reserve the right to suspend, restrict or terminate access to the Sick-Note Site and/or the Sick-Note Services for any reason at any time.

9.3 These Terms and Conditions shall be deemed to include all other notices, policies, disclaimers and other terms contained in the Sick-Note Site, provided that in the event of a conflict between any such other notices, policies, disclaimers and other terms, these Terms and Conditions shall prevail. If any of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

9.4 We shall ensure that we comply with the requirement of all current data protection legislation including, without limitation, the Data Protection Act 1998 (as replaced, modified or re-enacted from time to time). We shall only use personal data received from you for the purpose of fulfilling our obligations under these Terms and Conditions and as stated in our Privacy Policy.

9.5 A person who is not a party to the agreement between you and us has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of the Terms and Conditions but this does not affect any right or remedy which exists apart from that Act.

9.6 In respect of fraudulent misrepresentation, this agreement (including any documents and instruments referred to herein) supersedes all prior representations, arrangements, understandings, and agreements between you and us (whether written or oral) and sets forth the entire agreement and understanding between you and us relating to the subject matter hereof.

9.7 Your purchase will be deemed to have occurred in the UK. These Terms and Conditions shall be governed by and construed in accordance with English Law and the parties agree to submit to the exclusive jurisdiction of the English courts.

 

Intellectual Property

10.1 All other rights, including copyright, in this website are owned by Sick-Note. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non commercial use is prohibited without the permission of Sick-Note. You may not modify, distribute or repost something on this website for any purpose.

10.2 The trademarks, names, logos and service marks (collectively "trademarks") displayed on this website are registered and unregistered trademarks of Sick-Note. Nothing contained on this website should be construed as granting any licence or right to use any trade mark without the prior written permission of Sick-Note.

 

My Account service - terms and conditions

11.1 The Sick-Note.com My Account ('the Service') is provided as a complimentary feature by Sick-Note for your personal use subject to these Terms and Conditions. In order to provide the Service, we will hold certain personal information. Except to the extent that we are required or permitted by law, any personal information which we collect will be used solely for the purposes of providing the Service.

11.2 To register with the Service you must be over eighteen years of age.

11.3 When you register with the Service you will be required to create a password. You must keep this password confidential and must not disclose it or share it with anyone. You will be responsible for all activities and orders that occur or are submitted under your password. If you know or suspect that someone else knows your password you should notify us immediately. Should you forget your password, please use the password reminder service.

11.4 If Sick-Note has reason to believe that there is likely to be a breach of security or misuse of the Service or site, we may require you to change your password, or may suspend use of the Service.

11.5 You must ensure that the details you provide on registration or at any time are correct and complete.

11.6 You must inform us immediately of any changes to the information that you provided when registering by updating your personal details. You can update the details you have given us at any time by going to the 'Edit Profile' section of the My Account area of the website. This will ensure that the Service we provide is accurate and up to date. Please also visit this page OR email us if any of the information that we hold about you is incorrect or needs updating, or if you want us to delete any personal information.

11.7 Use of the Service is intended to assist with purchases to be made via the site. The Service must not be used for the following purposes:

Disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material.
